3. Web Site Links And Third-Party Sites
This Web site may contain links to other Web sites that are independent of this Web site. We make no representation or warranty as to the accuracy, value, integrity, completeness, or authenticity of the information or opinions contained in any such linked Web site, and any link to another Web site shall not in any manner be construed as an endorsement by us of that Web site, or of the products or services described therein. 5. Payment Security
The BLACK 1st COLLECTIVE fully recognises the importance of security regarding the credit card information you send us over the Internet. Our payment provider “PayPal” uses industry standard 128 Bit Secure Socket Layer (SSL) technologies to encrypt all of your personal information including debit or credit card numbers, names, and addresses. The encryption process converts the characters that you enter into code that is then securely transmitted over the Internet and finally unencrypted on “PayPal's” secure web server. When you place an advert on www.black1st.com, confirmation of the above is a small padlock appearing at the top of your browser indicating that any information provided cannot be viewed by a third party. We stress that we know of no documented cases of credit card fraud using the “PayPal” shopping system over the Internet. In fact your credit / debit card details are never relayed to us, nor are they shared with any other third parties.
6. Refund Policy
No contract will be deemed to exist between the customer and The BLACK 1st COLLECTIVE until the advertisement has been accepted for publication on the web site. In the event that we later reject an advertisement, because it does not comply with our terms & conditions, the customer will be refunded in full.
7. Limitation of Damages
IN NO EVENT WILL WE, OUR OFFICERS, EMPLOYEES, CONTRACTORS, SUBCONTRACTORS, SUPPLIERS, AGENTS, AFFILIATES, SUBSIDIARIES, SUCCESSORS OR ASSIGNEES BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTIAL, SPECIAL OR OTHER INDIRECT (INCLUDING WITHOUT LIMITATION, COST OF COVER) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR ANY SERVICES, CONTENT OR OTHER MATERIALS PROVIDED OR AVAILABLE HEREUNDER, OR USE OF ANY OTHER LINKS OR LINKED WEBSITE, EVEN IF WE ARE EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF WHETHER SUCH DAMAGES AROSE IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER LEGAL BASIS. THE TERM "DAMAGES" INCLUDES, WITHOUT LIMITATION, SOLICITOR FEES, ANY LOST PROFITS, BUSINESS INTERRUPTION, AND LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM. YOU ACKNOWLEDGE THAT THE ECONOMIC TERMS OF OUR AGREEMENT REFLECT THE FOREGOING ALLOCATION OF RISK AND SUCH ALLOCATION OF RISK IS A SIGNIFICANT INDUCEMENT FOR US TO PROVIDE THE SERVICES, WEB SITE AND OTHER CONTENT AND MATERIALS.
